Terms of Service

1. Agreement

These Terms of Service govern your use of getkitar.com and the Kitar device grading and dynamic pricing platform (the "Service") operated by PT Kitar ("the Company," "we," "us," or "our") (Jalan Jenderal Sudirman 52, Floor 21, Jakarta 12190, Indonesia). By accessing or using the Service you accept these Terms. Nothing in these Terms limits your statutory rights under the laws of your country of residence.

The Service is designed for use by buyback desk operators, refurbished device retailers, trade-in program operators, and recycling businesses in Indonesia and Southeast Asia. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Use of the Service

• You must be of legal age in your jurisdiction, or have appropriate business authorisation, to enter into a binding agreement.
• You agree not to use the Service unlawfully, to interfere with its operation, or to attempt unauthorised access to any account or system.
• You may not scrape, reverse-engineer, or copy the Service or its grading models except as permitted by mandatory law.
• You are responsible for maintaining the security of your account credentials. You must notify us promptly if you suspect unauthorised access.
• The condition grade and price suggestion outputs from the Service are informational tools to assist your commercial decisions. Final pricing and trade-in terms remain your responsibility as the operator.

3. Intellectual Property

The Service, including its grading models, pricing algorithms, software, and visual design, is owned by PT Kitar or its licensors and is protected by Indonesian and international intellectual property law. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended commercial purpose during your subscription term.

The Jakarta secondhand market demand data used to generate price suggestions is compiled and maintained by the Company. You may use price suggestions in your own buyback operations but may not resell or redistribute the underlying demand data.

4. User Content

You are responsible for the device condition images and any other content you submit through the Service. By submitting images, you grant us a limited licence to process, store, and analyse them solely to provide the grading and pricing output. We do not use your submitted images or grading data to train or improve our models without your explicit written consent. See our Privacy Policy for details on data handling and retention.

You represent that you have the right to submit any images you upload, and that doing so does not violate any applicable law or third-party right.

5. Subscriptions and Payment

Access to the Service is provided on a subscription basis at the rates published on the pricing page. Desk and Kiosk plans include a 14-day free trial with no credit card required. After the trial, continued use requires a paid subscription. Fees are billed monthly or annually as selected at the time of purchase. We reserve the right to modify pricing with reasonable advance notice.

6. Disclaimers

The Service is provided on an "as is" and "as available" basis. We disclaim all warranties to the maximum extent permitted by applicable Indonesian law. Grade outputs and price suggestions reflect our model's assessment of submitted images and current market data; they are not guarantees of resale value or device condition. Mandatory consumer warranties applicable in your country of residence are not affected by this disclaimer.

7. Limitation of Liability

To the maximum extent permitted by applicable Indonesian law, the Company's total liability for any claim arising from or related to the Service will not exceed the subscription fees you paid in the three months prior to the claim. This limitation does not apply to liability that cannot be excluded under mandatory law.

8. Indemnification

You agree to indemnify and hold harmless PT Kitar from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any third-party right.

9. Termination

We may suspend or terminate your access to the Service for material breach of these Terms, with or without prior notice depending on the severity of the breach. You may cancel your subscription at any time through your account settings. Sections that by their nature should survive termination will survive, including intellectual property, liability limitations, and governing law.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Indonesia.

Disputes arising from or related to these Terms or the Service are subject to the non-exclusive jurisdiction of the competent courts in Jakarta, Indonesia, without prejudice to any mandatory consumer-protection rights applicable in your country of residence.

11. Changes and Contact

We may update these Terms. Material changes are posted with a new "Last updated" date. Continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.
